ORCP 10 sets out the rules for computing time periods, and provides: “The last day of the period so computed shall be included, unless it is a Saturday or a legal holiday, including Sunday, in which event the period runs until the end of the next day which is not a Saturday or a legal holiday.”
This rule does not, however, apply to claims under the Oregon Tort Claims Act, ORS 30.275. There is no grace period for weekends and holidays when it comes to filing a complaint alleging claims under the OTCA. Strict compliance with the OTCA deadlines is jurisdictional, and compliance with ORS 30.275 is a condition precedent to recovery under the OTCA. Tyree v. Tyree, 116 Or App 317, 840 P2d 1378 (1992) rev den, 315 Or 644 (1993); Banks v. Deschutes County, 2008 WL 482874, *2 (D. Or 2008).
